An ex wife’s claim to a life interest and exclusive right to occupy a property was dismissed. Despite having agreed not to contest her divorce and in lieu of an order for ancillary relief, when the former husband died, the wife claimed to have relied on a promise that she would have the right to live at and have the sole use of her former matrimonial home, for life, rent free. It was however held that no such representation had ever been made. The wife was granted the right to continue living in the premises, interestingly, where the second wife also resided.
