Health body challenges Information Commissioner Office’s £90,000 data protection fine

The Central London Community Healthcare NHS Trust is appealing a fine of £90,000 by the Information Commissioner’s Office, which the UK’s data protection regulator handed out after the Trust had sent sensitive information on dozens of patients to the wrong person. The ICO had ruled that the mistake was a breach of the Data Protection Act and its serious consequences were foreseeable. It said that the mistake could have been avoided if there had been better processes and training. We shall wait to see how the Information Tribunal will rule in response to the appeal.
