The European Commission has issued a statement of objections to the Servier group and various generics companies regarding agreements which were allegedly anti-competitive under European Union law, as well as Servier’s abuse of a dominant position by the way it conducted itself. The Commission believes the Servier group had induced generics companies to delay entry into the market for the supply of the cardio-vascular drug, perindopril, by the terms of its patent settlements agreement and acquisition of scarce competing technologies. The statement of objections does not serve as a final decision, but the Commission will now take soundings from the companies involved to see whether it will decide that there has actually been a breach of competition law.
