Court of Appeal takes a bite out of Apple, agrees with Samsung

The Court of Appeal has ruled in favour of Samsung in its most recent court-based confrontation with Apple in relation to allegations of design right infringement. The initial ruling of the High Court was that Samsung’s Galaxy tablet did not infringe the registered design right of the Apple iPad, and the Court of Appeal has agreed with that opinion.

The Court of Appeal has ruled that, if the registered design right that formed the basis of Apple’s argument was as wide as it had claimed, it would prevent any competition to Apple in the market for tablets. The Court of Appeal also agreed with the High Court that Apple should pay for notices in various locations on the Apple website to correct the impression it had previously given that Samsung had copied its design.
