We can assist our clients in the recovery of losses incurred in their every day operating activities, for example, in recovering payments from customers who have been unjustly enriched as a result of an internal bank mistake such as where the Bank has misdirected a credit or payment, or made a duplicate payment in error.
Such cases need to be handled tactfully. Often the recipient of the monies is innocent and may be unaware of the mistake until it is pointed out to them. However, sometimes the recipient decides to be opportunistic or may be, has changed his or her position, in reliance on a mistaken belief that he or she was entitled to the monies.
The key to successful recovery is speed coupled with sensitivity. We need to rapidly identify those cases where the recipient is innocent from those where the recipient is opportunistic and act appropriately.
