			<content:encoded><![CDATA[<p>Microsoft is suing Comet for alleged copyright infringement over what the software giant claims is nearly 100,000 counterfeit copies of Windows Vista and Windows XP recovery CDs. It has alleged that Comet made the copies before selling them to its customers. Comet argues that creating back-up CDs to go with each new Microsoft Operating System based computer is a legitimate right that cannot be contracted out of under European Union copyright law. Comet’s argument, however, may fall down over the fact that it made the copies rather than its customer. If the case makes it to a court decision, it will be interesting to see whether a court rules that back-up copies can only be made by a user and not someone supplying the software.</p>

			<content:encoded><![CDATA[<p>Counterfeit goods that are in the European Union purely because they are in transit between non-EU countries cannot be seized by customs authorities, according to a ruling of the European Court of Justice. The goods can only be seized if there are grounds to suspect that they will be sold in the EU. The ECJ said that customs authorities must destroy counterfeit goods if the court or other authority believes based on evidence that the goods will be sold in the EU. The evidence could include sale of goods to a customer based in the EU or an offer or advert addressed to people in the EU, or some other documents showing this.</p>

			<content:encoded><![CDATA[<p>The European Commission has, for now at least, not taken part in a signing ceremony held by Japan to a new controversial international treaty. Various countries around the world, together with the European Union, have been negotiating the Anti-Counterfeiting Trade Agreement in private for several months. The process of negotiation has been controversial because of its secrecy and because of the scope of some of the provisions. The treaty would involve severe criminal sanctions and sharing of details of intellectual property rights violators with other countries. Several groups have put pressure on the EU not to take part. The European Commission has given the reason not to sign now of having to ensure that the correct representatives sign it. Whether or not any EU representatives do sign it eventually remains to be seen.</p>

The aim of the guide is to help businesses avoid liability for intellectual property infringement by their employees.</p>
<p>The guide also highlights that such actions can impact on the productivity and profitability of an employee to the business, whilst also risking legal action being taken against the business itself. Examples of infringing activity include an employee using work systems to sell goods both within the business and outside of the business, and even simply selling actual counterfeit goods from behind their desk.</p>

			<content:encoded><![CDATA[<p>A new website has been launched by Brand Information Limited in partnership with the Trading Standards Institute (TSI) to help protect online consumers from purchasing counterfeit goods. The website is called Brand-i and can be found at <a href="http://www.brand-i.org/">www.brand-i.org</a>.</p>
<p>The website is effectively a search engine which will list approved retailers for a particular brand. TSI have been keen to point out that the website is not a one-stop-shop, as some legitimate retailers may not be on the list. However, the website is likely to help divert consumers away from rogue retailers in an attempt to bring down the number of counterfeit goods on the market – 5 million counterfeit items were seized by the UK Border Agency in 2010.</p>

There are some common themes with the Hargreaves Digital Opportunity Report &#8211; in particular, ensuring that the economy is better equipped to adapt to the digital age. The Commission’s strategy includes:</p>
<ul>
<li>Continued push for a single European Union patent system.</li>
<li>Modernisation of the European Community Trade Mark system. This would include speeding up the registration procedure and increasing certainty over what constitutes a registrable trade mark.</li>
<li>Creating a comprehensive framework for copyright in the digital single market. That would include multi-territorial collective management of copyright so that there would be online copyright licensing. There would also be a consultation on user-generated content to see if there should be more freedom for amateur producers of non-commercial film to be exempt when incorporating other copyright works. In addition, the Commission said it would propose a Directive on permitted uses of orphan works, and it actually proposed the Directive this at the same time as the strategy document.</li>
<li>Replacement of the Customs Regulation to strengthen enforcement of intellectual property rights. As with the orphan works proposal, this was also introduced at the same time as the publication of the strategy.</li>

			<content:encoded><![CDATA[<p>The European Commission has published a proposed Regulation regarding the customs enforcement of intellectual property rights. If implemented, the Regulation would update the Counterfeit Goods Regulation 1383/2003/EC in the following ways:</p>
<ul>
<li>The rights and procedures regarding seizing infringing material would extend from the current position which catches goods infringing patents, trade marks, copyright or design rights. It would also cover trade names and semiconductor topographies.</li>
<li>Parallel imported goods contrary to European Union law would also be seized.</li>
<li>A new quicker procedure would be established to enable customs authorities to deal with goods abandoned by their owner for destruction without having to go through formal legal proceedings if the owner does not object within a short period of time.</li>
<li>Have a new procedure whereby rights owners do not need to be involved with the destruction of small consignments.</li>

<p>Paul Gershlick, a Partner at Matthew Arnold &amp; Baldwin LLP and editor of Upload-IT, comments: “We are no doubt going to see ever more attempts by counterfeit suppliers to make illegal money off the back of the Olympics. At the same time, there is going to be ever increased attempts by official Olympic organisers to stop this. There should be plenty more high profile cases in the next year and a half.”</p>

			<content:encoded><![CDATA[<p>Tiffany has lost a legal action brought against eBay in which the jewellery shop sought to hold the popular online auction site liable for sales made of counterfeit products through its online platform. The US Supreme Court has now refused to hear an appeal from the 2nd US Circuit Court of Appeals’ ruling earlier this year, that eBay was not liable. The Court of Appeals had said that it was sufficient that eBay had shown evidence of removing particular counterfeit items when this had been brought to its attention. However, that Court advised eBay in the future that it may need to warn users that certain products were fakes.</p>

			<content:encoded><![CDATA[<p>The United States government, through the Customs Enforcement Agency branch of the Department for Homeland Security, has shut down more than 70 websites that are alleged to have been offering pirate content or counterfeit goods. Included in the websites shut down were music download sites and sites selling fake designer brands of clothing.</p>
<p>The domain names in question are no longer accessible, and users are instead diverted to a webpage detailing that the domain name had been taken over by the government and listing the United States laws on copyright and counterfeit goods. It is believed that many of the websites are attempting to continue trading by moving to new domain names.</p>

This, they say, would open themselves up to even more counterfeiting than is already taking place. They argue that the styles of their packaging create barriers to counterfeiters &#8211; although those barriers are already overcome by many, with one in five UK cigarette sales estimated to be counterfeit. However, making it even easier to copy will worsen the problem, and mean that the Government collects less in tax revenues.</p>
<p>As Paul Gershlick, a Partner at Matthew Arnold &amp; Baldwin LLP and editor of Upload-IT, told Intellectual Property Magazine: ‘The purpose behind trade mark law is to protect consumers and provide them with guarantees of origin so they know there is a certain quality attached to the branded product. The Government needs to consider whether the origins of tobacco brands are worth protecting? The Government may think not for products that are considered to harm the public&#8217;s health. However, if the number of counterfeit products increases, could this actually make the products less safe? Is it a case of better the devil you know, and at least work with suppliers that at least agree to do business legitimately?’</p>

			<content:encoded><![CDATA[<p>It takes just seconds to set up sophisticated fake web sites. Those are the claims made by First Cyber Security, the Internet security business. The problem is growing. The number of counterfeit goods seized at UK borders has quadrupled in 10 years. This has been driven largely by web sales. Many sites use links from emails or social networking sites to drive traffic to their sites. Once there, many consumers are caught unaware that products are fake, say Trading Standards. Complaints to Consumer Direct about counterfeit goods rose from 1,900 to 2,800 in the last year.</p>
<p>The Intellectual Property Minister says that the consequences of fake goods are more significant than damage to brands – goods can be dangerous. This month, a teenager was badly burnt after he was electrocuted from hair straighteners that had seemed genuine.</p>

			<content:encoded><![CDATA[<p>Goods which are suspected of being counterfeit can now be destroyed without the brand owner having to go to court to get an order in respect of each consignment. This change reverses the rules which HMRC brought into force last year, which dramatically increased the costs and admin for protecting trade marked products. The new rules mean that brand owners can try to contact the importer to state that they believe the goods to be counterfeit. If the importer agrees or does not respond to the brand owner’s contact, the brand owner can now destroy the goods without having to go to court. This will now help brand owners protect their brands, particularly when trying to stop the importing of lots of small consignments of counterfeit material.</p>

			<content:encoded><![CDATA[<p>Tiffany has lost a legal action brought against eBay in which the jewellery shop sought to hold the popular online auction site liable for sales made of counterfeit products through its online platform. The 2<sup>nd</sup> US Circuit Court of Appeals ruled that eBay was not liable as it had shown evidence of removing particular counterfeit items when this had been brought to its attention. However, it advised eBay in the future that it may need to warn users that certain products were fakes.</p>
<p>This case contrasts with different results in a similar recent case brought against eBay in France by Louis Vuitton. That case is reported here: <a href="http://www.mablaw.com/2009/12/ebay-louis-vuitton/">http://www.mablaw.com/2009/12/ebay-louis-vuitton/</a>. eBay has also had mixed success in other cases brought against it around Europe by the luxury brands. In a case brought by L’Oréal last year in the High Court, eBay was able to show that it was not responsible for counterfeit products sold by its users; but the Court went on to refer questions to the European Court of Justice to rule on whether use of L’Oréal’s brand in sponsored links to direct users to listings for infringing goods on its site constituted trade mark infringement and, if so, whether eBay had a defence under the E-Commerce Directive for acting as a mere host without actual knowledge of the infringing activity. We await that decision from the European Court.</p>

			<content:encoded><![CDATA[<p>Peter Hustinx – the European data protection supervisor – has expressed concern that the anti-counterfeiting trade agreement currently being negotiated may not be protecting people’s data protection and privacy interests. He expressed regret over the fact that the European Commission had excluded him from the negotiations over Acta. Trade representatives of leading developed countries have been negotiating Acta for two years and the agreement is expected to be concluded this year.</p>
<p>The purpose of Acta is to protect intellectual property rights in software, music, video and pharmaceutical products against unlawful copying. Hustinx would like to ensure that the negotiating parties consider the balance between protecting intellectual property rights and data protection and privacy rights, rather than data protection and privacy issues being considered at the end. Hustinx particularly wants safeguards to apply to all data transferred out of Europe to countries that do not provide strong enough protection on data protection issues. Hustinx would like to see a public and transparent dialogue on Acta.</p>

			<content:encoded><![CDATA[<p>Nokia has persuaded the Court of Appeal to ask the European Court of Justice to answer questions surrounding the seizure of counterfeit goods which are passing through the EU in transit only. Under EU law, goods could be impounded if there is a genuine risk that they would end up in the open market in the EU. In this particular case, HMRC seized about 400 counterfeit Nokia goods at Heathrow Airport, but those phones were clearly en route from Hong Kong to Colombia. Therefore, under the relevant Regulations, the High Court could not agree to Nokia’s request for HMRC to impound the phones. On appeal, the Court of Appeal has now said that the ECJ has to rule on whether fake goods purely in transit in the EU from one non-EU country to another non-EU country could be seized by customs. 			<content:encoded><![CDATA[<p><em>Which? </em>magazine has accused Google of making millions of pounds from web sites selling counterfeit goods, such as those selling fake Ugg boots, Tiffany jewellery and GHD hair straighteners. It claims that the search engine giant receives up to £5 per click when users click on the sponsored links when those users have searched for the famous branded products. <em>Which? </em>says many of the goods are never delivered or are fake. In its defence, Google claims that it has strict terms and conditions about which adverts are allowed and if anyone breaches those terms – such as by offering counterfeit goods for sale – the adverts would be taken down immediately. It sales it has good systems in place to deal with this. However, GHD is concerned that some of the poor-quality mimic goods available from some sites that pay to be shown when users search under the GHD name are dangerous and could cause electrocution, serious burns and hair damage.</p>

			<content:encoded><![CDATA[<p>eBay has been ordered by a French court to pay Louis Vuitton’s owner £1.5m for failing to stop products being sold on the auction site. In 2008, LVMH obtained an injunction to prohibit the sale or purchase of any of their products on the auction site, whether they were genuine or counterfeit. Even though eBay has tried to stop LVMH’s products being sold on its site, it has obviously not done enough to stop this as 1,000 products were still advertised on eBay’s site since the injunction came into effect, the French court heard. Brand owners are largely concerned with stopping counterfeit products, but some also like to restrict the channels of sale to protect the products’ aura (and therefore the profits) – a model known as selective distribution.</p>
